Possession of a controlled substance is one of the most common drug charges in Texas. Under the Texas Controlled Substances Act (Texas Health & Safety Code § 481.115), it is illegal to knowingly or intentionally possess a controlled substance unless authorized by law. The penalties range from a Class B misdemeanor to a first-degree felony depending on the type of drug and the amount. Texas classifies controlled substances into Penalty Groups 1 through 4. Penalty Group 1 includes cocaine, heroin, methamphetamine, oxycodone, and fentanyl, the most serious group. Penalty Group 2 includes MDMA (ecstasy) and PCP. Penalty Group 3 includes Valium and Xanax. Penalty Group 4 includes certain prescription compounds. The penalty group and the weight of the substance determine the charge level.
Possession of less than 1 gram of a Penalty Group 1 substance is a state jail felony (180 days to 2 years). 1 to 4 grams is a 3rd degree felony (2–10 years). 4 to 200 grams is a 2nd degree felony (2–20 years). 200 to 400 grams is a 1st degree felony (5–99 years). Over 400 grams carries 10 to 99 years or life in prison.
Possession does not require that the drugs be found on your person. Constructive possession means you had care, custody, control, or management of the substance, such as drugs found in your car or home. The prosecution must prove you knew the substance was there and that it was a controlled substance. This is often a key battleground in drug possession cases.
Texas offers drug court programs and deferred adjudication for eligible first-time offenders. Successfully completing a drug court program can result in dismissal of the charges and no conviction on your record.
