How to Choose a Criminal Defense Attorney in Texas

Facing a criminal charge is one of the most serious situations a person can encounter. The attorney you choose to represent you can make the difference between a conviction and a dismissal, between prison time and probation, between a permanent record and a clean slate.

Not all criminal defense attorneys are the same. Here is what to look for and what to watch out for when choosing who will fight for your future.

1. Look for Actual Criminal Defense Experience

Criminal defense is a specialized area of law. An attorney who primarily handles divorces, real estate transactions, or personal injury cases is not the same as an attorney who spends every day in criminal courts.

When evaluating an attorney, ask:

  • How long have you been practicing criminal defense?
  • What percentage of your practice is criminal defense?
  • Have you handled cases like mine before?
  • Have you tried cases to a jury?

An attorney who has spent years in the criminal courts who knows the local judges, prosecutors, and procedures has a significant advantage over someone who handles criminal cases occasionally.

2. Ask About Their Track Record

Results matter. Ask the attorney directly about their track record. A good criminal defense attorney should be able to speak honestly about the outcomes they have achieved for clients.

Be cautious of attorneys who make guarantees. No attorney can guarantee a specific outcome anyone who does is not being honest with you. But an attorney with a strong track record of dismissals, charge reductions, and not-guilty verdicts is a meaningful indicator of competence and commitment.

Todd Rash's record is publicly verifiable: over 93.8% of his Dallas County clients were not convicted, and less than 2% served any jail or prison time. Those numbers come from the Dallas County government database not from marketing materials.

3. Evaluate Their Availability

Criminal cases move on a schedule that does not always respect business hours. Arrests happen on Friday nights. Bond hearings happen on weekends. Deadlines like the 15-day ALR deadline after a DWI arrest do not wait for Monday morning.

Ask the attorney:

  • Will I be able to reach you directly, or will I be passed to a paralegal or assistant?
  • What are your hours?
  • How quickly do you return calls?

An attorney who is genuinely available to their clients who answers their phone and returns calls promptly provides a fundamentally different level of service than one who is difficult to reach.

4. Assess Their Honesty

A good criminal defense attorney tells you the truth, even when it is not what you want to hear. They explain the strengths and weaknesses of your case honestly. They do not promise outcomes they cannot deliver. They do not take your money and then disappear.

During your initial consultation, pay attention to whether the attorney:

  • Listens carefully to the facts of your case
  • Asks thoughtful questions
  • Explains your options clearly and honestly
  • Acknowledges the challenges in your case rather than just telling you what you want to hear

An attorney who is honest with you from the beginning is one you can trust throughout the process.

5. Consider Their Local Knowledge

Criminal law is local. The way a DWI case is handled in Tarrant County is different from how it is handled in Collin County or Dallas County. Local knowledge knowing the judges, the prosecutors, the local court procedures, and the unwritten norms of the local legal community is genuinely valuable.

An attorney who regularly practices in the courts where your case will be heard has a real advantage over one who is unfamiliar with the local landscape.

6. Understand the Fee Structure

Criminal defense attorneys typically charge either a flat fee or an hourly rate. Make sure you understand exactly what is included in the fee before you sign anything.

Ask:

  • Is this a flat fee or hourly?
  • What does the fee cover? Does it include trial?
  • Are there additional costs I should expect (expert witnesses, investigators, etc.)?
  • What happens if the case takes longer than expected?

A reputable attorney will be transparent about fees from the beginning. Be cautious of attorneys who are vague about costs or who pressure you to sign a retainer agreement before you have had a chance to ask questions.

7. Trust Your Instincts

After your consultation, ask yourself: Do I trust this person? Do I feel like they genuinely care about my case? Do I believe they will fight hard for me?

Criminal defense is personal. You are trusting this attorney with your freedom, your record, and your future. The attorney-client relationship matters. Choose someone you believe in.

Red Flags to Watch For

  • Attorneys who guarantee specific outcomes
  • Attorneys who are difficult to reach or who pass you off to staff
  • Attorneys who pressure you to accept a plea deal without fully investigating the case
  • Attorneys who are vague about fees
  • Attorneys who do not specialize in criminal defense
  • Attorneys who seem unfamiliar with the local courts
